Law allows forced entry into real estate to combat Aedes

Beginning this Tuesday (28), agents of the Aedes aegypti mosquito can perform forced entrances in abandoned public and private real estate. The decision is contained in Law No. 13,301, published today in the Federal Official Gazette.

Forced entry into real estate must be done by a duly identified professional, in areas with potential outbreaks of transmitting mosquitoes. In addition, in order to prove the absence of a person who can authorize the inspection, it is necessary for the agent to make two prior notifications, on alternate and marked days and times, within a period of ten days. According to the Ministry of Health, initiative should be taken only in exceptional situations and aims to allow the implementation of mosquito control actions and breeding grounds. The origin of the law was a provisional measure published in February of this year.

The text deals with several measures of health surveillance that can be adopted when there is imminent danger to public health due to the presence of the mosquito Aedes aegypti. Among the measures, the law establishes the National Program of Support to Fight Diseases transmitted by Aedes (Pronaedes), whose objective is the financing of projects to combat the proliferation of diseases transmitted by the vector.

Within 30 days, be regulated the criteria and procedures for approval of projects of the program, with prioritization of the areas of higher incidence of the three diseases and municipalities with smaller amount of resources available; reduction of regional inequalities; in addition to the prioritization of dengue prevention, Zika and chikungunya.

According to the document, local managers will also be able to institute Saturdays as a work day for house cleaning, identification of mosquito outbreaks and other mobilization activities. The law also provides educational and guidance campaigns to the population, especially in the case of pregnant women.

Property owners who do not take steps to eliminate mosquito outbreaks may be fined in cases of recidivism. Law 6,437 already provided for these penalties (warning, fine and interdiction of the property). The novelty is that, in cases of recidivism, the owner will be fined 10% of the amount of the initial fine, and this amount will be doubled in case of a new recurrence, that is, after the third time there are striking mosquitoes.
